Agreement
These Terms govern your use of the Sovnel app and website (the "Service"), provided by Infocratic, an Ontario corporation ("Infocratic", "we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service.
Not medical, nutrition or dietary advice
The Service is for general information and personal logging only. It is not medical, nutrition or dietary advice, and does not diagnose or treat any condition. Calorie, nutrient and other estimates, including those generated by AI, may be inaccurate or incomplete. You must verify all information before relying on it. Consult a doctor, registered dietitian or other qualified professional before making decisions about your diet or health.
Use at your own risk
You use the Service and rely on any information it provides solely at your own risk and are responsible for your own decisions.
Your account
You are responsible for activity under your account and for keeping your sign-in secure.
Acceptable use
You agree not to:
- break any law or infringe anyone's rights;
- upload unlawful, harmful or offensive content, or content you have no right to share;
- interfere with, disrupt, overload or attempt unauthorized access to the Service;
- reverse engineer, copy, resell or exploit the Service except as permitted by law;
- use automated means to access the Service.
Intellectual property
The Service and its content belong to Infocratic or its licensors. We grant you a limited, revocable, non-transferable licence to use the Service for personal, non-commercial purposes. You keep ownership of content you submit and allow us to use it to provide the Service.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, INFOCRATIC DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR FREE OR SECURE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, INFOCRATIC AND ITS DIRECTORS, OFFICERS, EMPLOYEES AND SUPPLIERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, HEALTH OUTCOME, LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND CAD $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnity
You agree to indemnify and hold harmless Infocratic and its directors, officers and employees from any claims, losses and costs, including reasonable legal fees, arising from your use of the Service, your content or your breach of these Terms.
Termination
We may suspend or end your access at any time, with or without notice, if you breach these Terms or as needed to protect the Service. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination will survive.
Changes
We may change the Service or these Terms at any time. We will post updated Terms here with a new "Last updated" date. Continued use after changes means you accept them.
Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. You agree to the exclusive jurisdiction of the courts located in Toronto, Ontario.
General
If any part of these Terms is found unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. These Terms and our Privacy policy are the entire agreement between you and us about the Service.
